  3. 50% ya 40% of Basic Salary: Agar aap Metro city (Delhi, Mumbai, Chennai, Kolkata) me rehte hain, toh aapki salary ka 50%. Agar inke alawa kisi bhi Non-Metro city (Pune, Bangalore, Noida, Gurgaon) me rehte hain, toh salary ka 40%.

Example: Maan lijiye aap Delhi me rehte hain. Aapki Basic Salary Rs 50,000/month (6 Lakh/year) hai. Aapko HRA Rs 20,000/month (2.4 Lakh/year) milta hai. Aur aap actual rent Rs 15,000/month (1.8 Lakh/year) pay kar rahe hain.

  • Condition 1: Rs 2.4 Lakh
  • Condition 2: Rent (1.8 Lakh) - 10% of Basic (60,000) = Rs 1.2 Lakh
  • Condition 3: 50% of Basic (Delhi) = Rs 3 Lakh

Tax Bachane Ke Liye Zaroori Documents (Required Documents)

IT (Income Tax) department ki scrutiny aur tax bachane ke liye aapko apne company ke HR aur Accounts department me kuch valid proofs jama karne hote hain:

1. Valid Rent Agreement

Sabse pehla aur sabse zaroori document hai ek kanooni Rent Agreement. Isme aapka (Tenant) aur Landlord ka naam, ghar ka pura address, rent ka amount aur signature clearly hone chahiye. Agar rent agreement registered ya notarized hai toh aur bhi behtar hai.

2. Monthly Rent Receipts (Kiraye Ki Parchi)

Aapko proof dena hoga ki aap sach me har mahine rent pay kar rahe hain. Iske liye Rent Receipts ki zaroorat padti hai. Receipt par mahine ka naam, rent amount, cash/online payment method, aur Landlord ke signature hone chahiye.

Note: Agar aap mahine ka rent cash me 5,000 rupaye se zyada de rahe hain, toh receipt par ₹1 ka Revenue Stamp lagana aur uspe cross-signature karwana kanooni roop se compulsory hai. Agar online (UPI/NEFT) transfer karte hain, toh revenue stamp ki koi zaroorat nahi hoti.

3. Landlord Ka PAN Card (Agar Rent Rs 1 Lakh/Year Se Zyada Hai)

Agar aapka rent saalana 1 Lakh rupaye se zyada hai (Yani kareeb Rs 8,333 per month se upar), toh kanoon ke mutabik aapko HR department ko apne Makan Malik ka PAN Card number dena zaroori hai. IT department ye track karta hai ki landlord is rent ko apni income dikha kar uspe tax bhar raha hai ya nahi. Agar landlord ke paas PAN nahi hai, toh unhe ek written Declaration (Form 60) dena hoga jisme likha ho ki unke paas PAN card nahi hai.
